Song-Beverly / Tanner Act ## Lemon law basics - Covers new cars, and used cars sold with the factory warranty, for the length of that warranty. - The manufacturer, not the dealer, must repurchase or replace a car it can't fix in a reasonable number of attempts (at least two). Law firms also cite 30+ days out of service. - Applies to EV battery, motor, charging and software faults that impair the car. - Keep every repair order. Free state-certified arbitration is available. - **New since 2025:** AB 1755 added a statute of limitations, a pre-suit notice to the manufacturer, strict response deadlines and mandatory mediation. SB 26 (signed April 2, 2025) made those rules opt-in for manufacturers, so the process you face depends on the brand. Business & Professions Code §9884 ## Before and after the job - **Written estimate first.** It must show the total price for parts and labor and itemize the repair. - **No surprise overruns.** The shop needs your authorization before going over the estimate. - **Detailed invoice** listing every part and labor item, and marking used or rebuilt parts. - **Your old parts back**, if you ask when you sign the work order. Ask for them on any battery or drive-unit job. CARB · Advanced Clean Cars II ## Battery and powertrain warranty - Tesla's own battery warranty is 8 years, with a mileage cap that depends on model and trim. - CARB rules add a state floor: ZEV powertrain parts at least 3 yr / 50,000 mi, and for 2026+ model years a battery that must keep at least 70% of its energy, rising to 75% for 8 yr / 100,000 mi by MY2031. - Congress revoked California's ACC II waiver in 2025 and the state is fighting it in court, so confirm which terms apply to your VIN. Why it breaks Pre-2021 cars use a lead-acid 12 V battery that often fails in 12–24 months. Newer cars use a 16 V lithium pack. Fix Replace the battery. Check whether your car is 12 V or 16 V first. Disconnect in the order the service manual gives; the wrong order can damage the DC-DC converter. Lithium upgrades (e.g. Ohmmu) are an option for older cars. Why it breaks Rubber bushings in the front lower lateral link (caster arm) tear. The squeak usually comes from a dry upper control arm ball joint. Fix For a squeak, try greasing the upper ball joint first (free). For a clunk, replace the lower rear arms or the full control arm set (MEYLE HD, Unplugged, EVANNEX). Get an alignment afterwards. Some owners heard clunks first. On failure the wheel toes out, steering pulls hard, and the car needs a tow. Why it breaks Under investigation. NHTSA says the 156 complaints go beyond the earlier small recalls (21V-835, 23V-235) and don't look like the same production fault. The same link's worn bushings are the classic Model 3/Y clunk (card above). Fix If the car pulls or the wheel sits at an odd angle, don't drive it; call Tesla Roadside. With an earlier clunk, get the lateral links inspected and keep the repair order. Out-of-warranty owners who pay for the part now should keep receipts in case a recall with reimbursement follows. Parents have been locked out with a child inside in summer heat. Why it breaks The door latches are electric. When the low-voltage battery dies there is no exterior mechanical release. Fix Never ignore a 12 V warning; replace it (first card). Show every driver and passenger the interior manual release (front door: lever by the window switches; rear doors vary by model). On a Model 3/Y with a dead battery, a jump pack on the two leads behind the front tow-eye cover pops the frunk so you can reach the 12 V. In an emergency with someone inside, call 911. Why it breaks Usually one weak module or cell group, a coolant leak into the pack, or a failed sensor or contactor, not the whole pack. California heat speeds it up. Fix Typical 2026 prices: Tesla full pack $10,000–16,000 installed (up to $20,000+ in hard cases); independent shop with a refurbished pack $8,000–12,000; module-level repair $2,000–7,000 where possible. Ask for the diagnosis in writing, ask for your old pack or modules back (your BAR right), and check that the shop can run Tesla's software calibration afterwards. Reported on RWD, AWD and Performance. Why it breaks Sources disagree: the rubber isolator between strut and upper control arm mount, the pencil braces, or a corroded upper ball joint. Some rear-sounding rattles are loose C-pillar trim. Fix Open a warranty service request and ask about any applicable service bulletin. Replacing the upper control arm mounts and removing the pencil braces reduced the noise for some owners but did not end it. Coilovers and lowering springs don't help. Repeat visits for the same noise build a lemon law record. Why it breaks Microswitches, a plastic gear and the wiring harness inside the handle fail at 40–80k miles. Fix Pull the fuse for 2 minutes and reinstall (owner tip, not guaranteed). Why it breaks In 2022 a software bug left a heat pump valve open and stopped the compressor, mostly at 14 °F and below. If it persists on current software, suspect the Octovalve, a sensor or a refrigerant leak. Fix Update software and leave climate on Auto. If the alert stays, book service in the app; it needs diagnostics. Gen 2 doors not flush, loose trim. Why it breaks Complex air suspension and fast-changing software; battery and motors are holding up well. Jan 2026 recall: about 20,000 R1 trucks were serviced with an outdated procedure that could leave the rear toe link joint loose. Fix Check the VIN for the toe link recall. Try the two software resets for false error messages. Air leaks and height faults need a service visit; ask whether mobile service can come to you. Keep records; repeat suspension visits support a lemon law claim.
